  • What is Probate?

    Probate is a process where the Will (if there is one) of the deceased is authenticated by the Court and one or more people are given the legal authority to administer the deceased's estate.   

  • What is an Executor?

    An Executor is a person named in the Will who is responsible for administering the deceased's estate. There may be more than one Executor. 

  • What is an Administrator?

    In certain circumstances, such as when the deceased did not make a Will. The person who is responsible for administering the deceased's estate is known as the Administrator, usually this will be their next of kin. There may be more than one Administrator.   

Risks for Executors and Administrators

There are many risks for Executors and Administrators when dealing with the administration of an estate, for example:


  • Executors and Administrators are responsible for dealing with claims against the estate 


  • You can be personally liable for the debts of the estate. For instance, if a creditor comes forward after an estate has been distributed, you may be personally liable for money owed to the creditor


  • Where there is more than one Executor or Administrator there may be disputes between them 


  • As an Executor or Administrator, you need to ensure you do not make any mistakes, as you can be held accountable 


  • Disputes may arise with beneficiaries and beneficiaries may commence legal proceedings against executors and administrators in certain situations 


  • Dealing with the tax affairs of the Estate and ensuring that any tax is paid within the required timeframe. HM Revenue and Customs can issue penalties against the Estate if tax returns are filed late or tax is paid late. They will also charge interest on unpaid Inheritance Tax once the deadline for paying it has passed

Signing a Probate application form

Grant Only Service

With this service we will help you by completing the application and applying for the Grant of Probate or Grant of Letters of Administration, as appropriate. We will also complete the relevant Inheritance Tax Return. You will need to provide us with full details of the estate to enable us to do this and you will be responsible for the administration of the estate. 


There are many risks for executors and administrators and administering an estate can be time-consuming, complex and stressful. You may find this overwhelming, especially at a time when you are grieving. If you need more help we offer a Probate and Estate Administration Service. 

Probate and Estate Administration Service

As well as completing the application, applying for the Grant of Probate or Grant of Letters of Administration, as appropriate and completing the relevant Inheritance Tax Return. We will also undertake the administration of the estate for you. This will include among other things collecting in the assets, preparing the Estate Accounts and distributing the estate to the beneficiaries.
